Actually new.net has made it quite clear that you must either download the plug-in or append .new.net to the domain in order to resolve it.  It's fairly prominent on the site and not confusing to consumers.  That is not fraud.  They make no claims to be included in the legacy root. The same is true for other roots and the TLDs carried in those roots.  It is clear that they are not ICANN related.
