domain name rights
For the new top level domain names that will be created in the near
future, I would like to make a few suggestions that may or may not
already been considered.
I would like to see it set up to minimize the 'domain name brokering'
business. If someone applies for a name not previously taken, in many
cases that requested name would go on a holding list available for the
internet community to see.
First rights for a name would go to someone who had a trademark on the
name.
(They would not have to go on a holding list.)
Second rights would go to someone who had an existing business with that
name (but not a trademark) and had a means to validate it (such as a
state resale tax certificate). Perhaps this group would go on a 30 day
holding list (in case someone with a trademark on this name applied for
this name). If in the 30 day holding period if someone with a trademark
right to the name applied for the domain name they would be able to get
it.
Third rights would go to anyone else who wanted this name. They would go
on a longer holding list, say 90 days. Then if someone with a trademark
right to the name applied for it within the holding period they would be
given the name. If within the holding period no one with trademark
rights applied for the name, the first entity with a validated business
name would get the name at the end of the 90 day period.
Another problem to address is this : A business with a validated right
to a name applies for and gets the domain name but does not have a web
presence i.e. web page within a certain period of time should give up
its right to the domain name to another business who also has a
validated right to a name who has or will establish a web presence.
