Hi Tim,

I have also read the letter/contract you all have with Commerce, and review
you info on registers. I will be glad to you email in the litigation to
come, ICANN will be named as a party.

It is interesting that ICANN position is that they authorized entities to
register names, and then sized those names, at will, extort money, commit
wire fraud and mail fraud. And also interesting that ICANN policy is such
that it will assist and approve of credit card fraud, exdotation, wire
fraud, and mail fraud. And in all of this ICANN has not duty to supervise or
act !

This litigation is coming, I have been to law school and worked on a number
of large case against defendants just as you all, that scream, that they
have no duty to supervise thier agents and can not be named in such actions.
Let me assure you can, ICANN will be named in a federal court, and learn,
that you all do have specific and legal duties and the breach of these
duties, will end in liability.

Please forward to me ANY matterial that you have that relates to ICANN
authority to permit registers to commit mail fraud. And any information that
indicates that ICANN is under no duty to act, when ICANN has notice and
knowledge of such conduct.

ICANN is under a specifc duty to not allow it agents / contractors to engage
in mail fraud. It will be interesting to see how you all explain to a
federal judge how you can contract to some one to perform a operation, and
then have no duty to supervise.

This is a serious matter, that is the reason that I follow up with
registered mail copies, I do not want anyone of these defendants to get to
court and claim they have no knowledge.

Dear Mr. Moore,

I have been forwarded several copies of this inquiry that you have sent to
numerous people at ICANN and will take this opportunity to respond.  Please
understand that ICANN's role is limited.  ICANN is a non-profit corporation
that has responsibility for Internet Protocol (IP) address space allocation,
protocol identifier assignment, generic (gTLD) and country code (ccTLD)
Top-Level Domain name system management, and root server system management
functions to preserve the operational stability of the Internet.  ICANN does
not have direct responsibility for the actions of resellers, but we do
contract with registrars (through which resellers do business).  ICANN's
authority with regard to registrars is limited to a contractual relationship
governing the registration of domain names, but we do not oversee
contractual disputes related to payment of registration fees.

Based on the information you have provided, it does not appear that there
has been any violation of ICANN policy that would qualify as a violation of
the registrar contract with ICANN.  A copy of this contract can be found at
http://www.icann.org/registrars/ra-agreement-17may01.htm.  Should you review
this contract and find that there has been some violation that we have not
found, please inform us and we will gladly investigate.

While we are not suggesting that your concerns are unfounded, they just do
not fit within our scope of authority.  We have contacted the registrar to
pass along your concerns and were informed that this was a financial or
contractual matter between you and your reseller.  As such, there is nothing
for ICANN to do.  You may wish to contact an attorney for legal advice or
the appropriate law enforcement or consumer protection agency if you believe
that illegal or inappropriate activity is taking place.
