Hi, Legal@xxxxxxxx
Thanks for your replay, I have read your replay and have to wonder if you
actually get people to go alone with this babble. You may not realize that
my relationship as to this domain name is with Registerfly.com, their police
is stated below as to renewal and redemption. You should note that it states
30 days for renewal and 30 days for redemption. Registerfly is you agent,
and this is the police that Registerfly presents and binds you also. You
should also note that Registerfly.com returned this name to my account and
informed that it was in fact mine, well after the date Enom.com asserts that
it sold it to Insane Domains!
RegisterFly.com allows a 30 day grace period after a name expires. During
this 30 day grace period you can renew your domain. After the 30 day grace
period expires your domain will move to the redemption period for 30 days
prior to being dropped and made available again for registration. Once the
domain is placed in redemption you CANNOT renew it via our interface.
In view of of Registerfly policy, you have a problem. It is clear that, you
never intended to comply with these terms, even though you are and were
aware of it. This constitutes an admision of fraud, on your part, and theft.
Both very serious matters, and impose serious liabilities
Next you assert that the name was not renew, because Registerfly.com failed
to do something, this is not my problem, it is your, and you were placed on
notice as to registerfly's conduct. Again, a very serious problem and
admission on your part, which imposes considerable liability.
Registerfly.com is your agent and your responsibility. Their failure is your
failure and their liability is your liability.
You big problem is the renew date, this domain has shown renewed since
December. as it was renew by Registerfly.com. The renewal data is reflection
of one year from my date of registration, as is required by ICANN rules and
polices. It would appear that Enom.com is admitting that sold a name, with
out one year of registration, in violation of ICANN's rules and polices. In
light of all of the emails and registered letter that Enom.com has received,
Enom.com should have conducted an account of this and the domain names in
dispute. In any event Enom.com, today admits it sold a renewed name, after
notice !
You ask how you altered data in the Versign data base, since this domain,
according to you were SOLD to Insane Domains on 2/19/2006, and the renewal
data is 1/16/2007, anyone of common sense can see that all Enom.com did was
edit the owner and other information to reflect Insane Domain information.
There was not a new record created, as is required by ICANN rules and
Polices in a sale or transfer. Enom.com will learn that Federal Judges are
not stupid, and will see that this is a real problem. When this is view with
Registerfly.com email notices, charges and renewal confirmations emails,
Enom.com has problems, very BIG problems and lots of liability.
And then, Enom.com must face the impossible position that it's agent,
Registerfly.com prohibited me from renewing any names for a period of time,
being the same period of time at issues. This action was supported by
Enom.com after recieving notice of such action by Registerfly.com. This
being in violation of all terms of the agreement of Registerfly.com and
ICANN rules and polices. Now Enom.com asserts that it can take a domain name
and sell it after it's agent refuses to allow it renewal, with the right of
renewal being refused with Enom.com assistance and approval. Do you real
think that Federal Judges are this stupid, or that a jury is this stupid.
Emon.com, has very, very, very serious problems with this defense. In fact
it is an admission of liability !
After reading your email and admissions, which is many, my demand now is
$250,000 for this wanton conduct, remember there is no contractual
relationship between me and Enom.com, you have nothing to hide behine !
Provide me your agent for process, I do look forward to see you all in
Birmingham, and watching you all in depositions.
Thanks,
Michael Moore

Below is the information as it appears in eNom's renewal database. It
shows the date in which the domain was marked as expired as well as the date
that the domain entered the auction queue (AU = auction).
326509843 2/16/2006 9:59:03 AM AU
326509843 1/17/2006 2:00:11 AM Domain marked as expired
326509843 1/1/2006 1:23:49 AM support@xxxxxxxxxxxxxxxxxxxxxx 2nd
Warning e-mail - Auto-Renew is set to OFF Warning
326509843 12/18/2005 4:48:22 AM support@xxxxxxxxxxxxxxxxxxxxxx
Warning e-mail - Auto-Renew is set to OFF Warning
I am unclear as to what information eNom allegedly altered in the
Verisign database? The currently listed expiration date (1/16/2007) is
indicative of the original registration date (1/16/2005 @ 12:11:19 PM
Pacific Time). As per the records above, eNom did not process a renewal
command prior to the expiration of your registration period for the domain.
The domain was subsequently placed into our auction queue on 2/16/2006 @
9:59:03 AM Pacific Time and purchased by the now currently listed
registrant.
The domain name was never transferred and we do not require your
authorization to sell a domain name which you have defaulted upon. You were
allotted the same grace period to renew the registration as is given to
every eNom registrant. Once a domain name expires it is held for a period of
42 days where the previous registrant may still reactivate their
registration whether or not is has been auctioned (please refer to our
registration agreement http://www.enom.com/terms/agreement.asp). This is not
a mandatory grace period, but one implemented upon eNom, by eNom.
I would be very interested in seeing where eNom's relationship with
RegisterFly was ever denied by eNom. Our main business model is based around
our reseller partners. It is hardly and unknown fact throughout the industry
that RegisterFly is an eNom reseller partner. However, all this means is
that RegisterFly uses eNom's registry connection to facilitate domain
transactions for their customers. It may have been previously noted that
RegisterFly is an ICANN accredited registrar themselves and that happens to
be a fact.

eNom, Inc.

Subject: RE: Holdemschoolonline.com
Hi,
I did not know that Enom.com had any employees in their legal department.
That is good. Can you send me your agent for process information ?
As to HoldemSchoolOnline.com the data in this case is clear, the current
renewal data is for 1/16/2007, demonstrating that Enom.com, stole the name,
being the crooks and thefts they are. The records and data speak for them
self's. Now does Enom.com intent to alter the data at Versing again,
unlawfully in an attempt to conceal their criminality?
I do think you for clearing up your relationship with Registerfly.com,
never the less, every with the current false statements, the name was sold
by Enom.com contrary to ICANN and Registerfly.com polices. See
Registerfly.com stated policy below. Also see ICANN police on names not
renewd and release.....and See the current renew date, 1/16/2007 not
February 19, 2007 nor is it March 15, 2007. In fact, Enom.com has notice of
payement viva the certificed check sent by me to Registerfly.com, viva
registered U.S. MAIL to Registerfly.com, and that Registerfly.com deposited
this check into it's account. Registerfly.com being, Enom.com agents....IN
THIS MATTER !!!!!!!!!!!!!!!!!!!!!!!
Again, I am demanding, $100,000 in damages against Registerfly.com,
Enom.com and ICANN for this theft. This will also apply for any and all
other names that Enom.com sell or transfer to any other person that
Registerfly.com and ENom has failed and refused to return to me. .As I
stated to you all in January, this matter is not going to go away, but will
be resolved in Federal Court. Contrary to Enom.com believes, you can and
will be named in a complaint. See you all in Birmingham...Alabama.
As to this name, it also will be a point of litigation, if not returned !
I would remind you, I HAVE NO CONTRACTUAL RELATIONSHIP WITH ENOM.COM. It
should be noted, that in the past, Enom.com in the other singe email I
received from Enom.com, Enom.com deny any relationship with Registerfly.com.
But since Enom.com now admits that Registerfly.com is it's agent, any and
all liability that Registerfly.com has created may be also imposed up
ENOM.COM. Since Enom.com has been make aware of all of the conduct of
Registerfly and in fact support Registerfly.com in their thefts, Extortion,
Wire and mail fraud, through emails and registered U.S. MAIL....Enom.com
exposure is more that considerable !
At this time, I am place all, ICANN, Enom.com, Registerfly.com,
Versign.com and Domain Insane, scott.pearse@xxxxxxxxx]On Behalf Of Domain
Insane on NOTICE, that this domain name, HOLDEMSCHOOLONLINE.COM is my
property, that Enom.com knew this at the time Enom.com altered the data in
Verign data base to Reflect the owner as Domain Insane and other information
therein. That the renew data demonstrates that Enom.com was aware of such.
ICANN rules and polices are clear on renewal and transfer. I HAVE NOT GIVEN
ANYONE AUTHORITY TO TRANSFER THIS DOMAIN NAME !
The level of criminality and corruption that has taken over at ICANN and
it agents like Enom.com and Registerfly.com would make the hardest member of
the mafia proud. This is organized crime at it best. Rob, steal, extort and
make so much money. How may names have you and registerly.com stolen and
sold like this ?
Now, would any one care to state the date that this name was placed up for
auction ? I would bet that this question goes unanswered !
I have attached the complete support ticket at registerfly.com below as to
the Domain name Holdemschoolonline.com.
If you or any of the above parties have any information that disputes the
above facts provide them to me in writing.
In fact, I challenge, ICANN, Enom.com, Registerfly.com, Versign and the
Department of Commerce to make any statement....being the cowards and thefts
that you all are...I expect none, and look forward to seeing you all in
court, humbled from your presumed positions if absolute power. You all
stole and extorted from the WRONG PERSON THIS TIME !

Subject: RE: Holdemschoolonline.com
The registration on the domain name expired and the domain name was
placed into eNom's pre-release auction queue. When a domain is placed in
this queue, it is never deleted, thus the creation date does not change.
After the close of the auction the domain name is moved to the winning
bidder's eNom account.
The domain name in question was registered through RegisterFly, who
is an eNom reseller. They are a separate company and have their own customer
base, but their domain registrations reside on eNom's backend database. As
far as the registry is concerned, eNom is the ICANN accredited registrar for
the domain. When the domains expire, they still reside in eNom's database
until we delete them.
eNom does not handle credit card processing for RegisterFly and we
do not have any record of a renewal for this domain name. If we receive a
renewal command from one of our resellers, the name is renewed. That was not
the case in this instance.

Thanks for you reply,
You analyst is correct, except, Enom transferred the name to you, you
did not register it as a new registration. Yes, I do have a records and
payment for the renewal at REGISTERFLY.COM not ENOM.COM.. So the name, was
not expired, nor was it registered at Enom.com. And Enom.com never had any
interest in the name in any manner what so every.
I am enclosing registerfly.com renewal polices below;
RegisterFly.com allows a 30 day grace period after a name expires.
During this 30 day grace period you can renew your domain. After the 30 day
grace period expires your domain will move to the redemption period for 30

If you look closely at registerfly replay, they assert that it was
transferred to you on March 15, 2006. The real problem, ICANN rules prohibit
any domain from be transferred without the owner consent. I am the owner and
I have not given consent. You did not register the name, Enom transferred it
to you unlallwfully. You are a victim of Registerfly and Enom.com fraudulent
practices, just as I am. That is the reason that Enom.com will not reply to
emails or state the date of transfer. I have sufficient documents including
a certified check mailed to REGISTERFLY.COM by U.S. Mail and cashed by
Registerfly.com, as well as hundreds of emails and many registered letters.
Enom.com never had any interest in the name, it was never registered with
them, and they were never the owner. All names must be registered, by the
owner. My name was transferred to you, I have not give my consent to nay one
to transfer this name.
I do not wish any ill will to you, I hope you understand that now. As a
company that deals in Domain names, you can understand the criminal conduct
that has occurred here. If you have domains at Emon.com or Registerfly.com,
they are at jeporady. It is sad to say, that ICANN has turned the internet
in to this mess where the criminals have taken over.
I myself am moving forward with plans to file suit on this matter, I
will be flying to the US in several week to sign several complaints and
start a class action suit against ICANN and the US based registers as to
their unlawful practices. At that time I also plan to take some action as to
this domain name and 26 other that Registerfly and Enom.com have stolen from
me. They are sure they can not be named in a suit, but I plan to demonstrate
to them that this is not in fact true. I went to law school and have worked
on a number of class action for firms. It was not problem in find a law firm
to file suit, after I gathered the evidence. Over the next few months you
and all who have registered names will be invited to join and recope funds
that they have stolen from you in the registration process.
I regret our first contact being adversary, I hope you can understand, I
have money invested in this name, and do want it back. All of the names
stolen were poker/gaming related, names they knew they could sell and
transfer for a profit.
You should note that note of the people that we are CC these emails to
deny these statements as fact. Enom.com reply to you were vague, and none
descript.....they know they are nothing more that thefts and crooks. You
should also notice, that ICANN has not replied any, nor has register
fly.com, nor has Versign. All are aware of there conduct, and do not wish to
place them self 's in any greater danger. We are dealing with criminals and
cowards. I have chose to call them all, the Internet Mafia. This is
organized crime.
At this time we have the following facts, You did not register the name,
it was transferred to you by Enom.com, The name was not registered at
Enom.com, but registered at Registerfly.com, You state that Enom.com
transferred the name to you on February 19, 2006 and Registerfly states the
name was transferred to you on March 15, 2006. The Information at who-is,
support neither version, and show that the name was renew on January 15,
2006 for a year. I , As the owner of this name, never authorized the
transfer.
If you or any of the above parties have any information that disputes
the above facts provide them to me in writing.

Subject: Re: Holdemschoolonline.com
Dear Sir,
I bought the domain on 19 February 2006, which is more than 30 days
after the period for which you registered the domain had lapsed.
The creation date shows as 15 January 2005 as this is the date that
the domain was created. As previously stated by yourself the whois record
changed on 19 February 2006 to reflect my purchase from eNom.
It is probably best to think of domain registration as a leasing
processes. If you do not pay the yearly renewal fee then the domain is
available for somebody else.
If you were leasing a vehicle and didn't keep up with the payments
then the leasing company would take the vehicle back and look for someone
else to lease it. In doing so the vehicle's manufacturing date would not
change (eg 15 January 2005).
I have a record of the domain purchase from eNom on 19 February 2006.
The question you need to be asking yourself is, do you have a record
of a domain registration renewal for the period 15 January 2006 -> 16
January 2007.
Please state what claim you have to the domain after the renewal
period has lapsed.

Scott Pearse

Can Emon.com not make this statement, and do you not have any emails

The Records appear to show that the transfer was not as emon.com
asserts. Someone is lying. My experience is that thefts when caught lie!
This is nothing more that criminal, and they have been caught. In the U.S.

Again, I am asking you to state when you acquired this domain name.
Do you have some problem in make a statement as to this date? It should be
clear to you at this time, that Emon.com, is nothing less that a bunch of
criminals, with Regitserfly.com and ICANN. That lie cheat and steal as a way
of business. The Renew date date demonstrates that you acquired before
1/16/2006, and We both know you did not create this record on 1/16/2005.
Sir I ask you again, state the date you acquired this Domain, and do
you have any statement as to how the Versign data base shows you to have
create tis record on 1/16/2005.

Dear Mr Moore,
I have forwarded your comments to eNom and they have issued the
response below.
Regards,

All expired domains are provided a grace period, during which
time you can renew the domain at your regular rate. In this case, the grace
period for renewal has lapsed and this domain was purchased by another
client through eNom's Pre Release Auction Services. Pre Release Auctions are
comprised of domain names that expired and have gone beyond the 30 day
renewal grace period.

Hi,
Thanks for your reply. As I stated before, I am in the process
of gathering evidences of Enom.com and Regiosterfly.com criminal conduct.
This Domain is one of many that Registerfly, stole and Enom.com helped; this
is the first one they sold. Needs to say, this is will get ugly before it is
over. Both Registerflyc.om and Enom.com believe them self's beyond the reach
of the courts.
There is very conflicting data as to the sale of this Name, the
records indicate that you all created it on 1/15/2005, which is false, and
there has been three different dates as to last updating, the first was
1/16/2005, then there was 2/19/2006 and then changed again to 3/15/2006. As
you know all of this in formation is false. It does appear that Emon.com
sold you all the name, before it expired, and not as represented. I have
deep concerns that Emon.com can alter the data in the Versign data base as
to dot com names to cover up their criminal conduct, as should you. This
demonstrated that Enom van steal and sell names at their will and cover up
their conduct by altering the data at versign any way they want. You as I,
owner of domains names now at the mercy of this mafia that now runs the
Internet.
I have copied the date from Emon.com, for you review, as you can
see, the name was created on 2005-01-16, I know and you know that you did
not create this recorded on this date but that I did, like wise, the renew
date is 2007-01-16 demonstrating that it was in fact renewed on this date. I
have documents this criminal conduct; there will be no disputing this
evidence.
If you have documents [Mike Moore] or emials as to the sale or
transfer of this domain name to you, I am asking that you provide such to
me. I view this name as being stolen and do plan to file criminal charges
against Registerfly.com and Enom.com as well as seek civil damages.
I am disputing your rights to use or possess this name as
provided by the rules and regulation at ICANN.

Hello Scott,
You can let Mr. Moore know that the domain expired 1/17/2006 and
was not renewed within the renewal grace period. Thus, the domain was put
into our Pre Release auction and was purchased by you.
If he has any questions regarding why the domain was not
renewed, he will need to contact his former reseller, RegisterFly.com
(please see contact information for RegisterFly to follow).

Dear Scott Pearse,
It has come to my attention that my property,
Holdemschoolonline.com has
been transferred to you. I have made several inquires as to this
to
Registerfly.com and Enom.com without reply. When and how did you
acquire
this domain name. The who is data also states that you
registered it in
2005, I am in possession of considerable undisputable data which
demonstrated that I was the person that registered it in 2005
and it was in
registered in my name till 1/16/2006. I find all of this very
upsetting. I
have to wonder who could have change the data at Versign, as to
owner and
contact, but left the created date unchanged.
Do you have any information that you can forward to me as to
when and how
you acquired this domain name. I am in the process for filling
litigation in
the U.S. Federal Courts naming Registerfly.com , Enom.com, ICANN
and Versign
as defendants as to a number of Domains names and their criminal
actives. I
also plan to file a criminal complaint as to these matter also.
Theft is a
serious matter, I plan on follow up on these issues, to a
conclusion.
