Hi Legal@xxxxxxxx,

I am sure that you will find your relationship with Registerfly.com imposes
much more responsibility and liability that you desire. You will also learn
that Registerfly.com can and does bind Emon.com. You have been presented
with the proper facts and information, through emails and registered letters
as required by law. Contrary to your believe, you do have specific duties,
one is to not allow your agents to engage in unlawful conduct, and to
interview when you are placed on notice.

After dealing with Registerfly.com, there is no way in the world I would
every authorize you to place any charges on any credit card for any reason
what so every. And as this demand today differs for you past demands for
money to return my property, it also demonstrate your bad faith. How can
anyone trust Enom.com, your conduct has been totally dishonest.

I have read and studied ICANN rules and the documents at the Commerce
department, I am sure you are not following ICANN's rules, nor does ICANN as
to that matter. And you are under an absolute duty, as to the law. I am sure
that the Federal Courts will be an eye opening experience for Enom.com.

Today, you seek to extort funds for the return of property that is lawfully
mine, for many reasons. The only reason these name are in redemption is
because of the tortoise conduct of Enom.com and Registerfly.com. Enom.com
will have to learn the hard way you can not prohibit some one from renewing
domain names and then extort funds from them because of your actions.
Registerfly.com and Enom.com is responsible for this matter and it is their
responsibility to remedy it. If some one is to pay $160.00 per domain name
to redeem these names, it is the responsibility of Enom.com and
Registerfly.com to do so. I have attached the ICANN rules as to register and
renewal fees, for your review

And Enom.com, has a direct responsibility to supervise Registerfly.com and
as you have admitted, had a duty to allow me to renew the names, and failed
to do so, and now face serious damages. This with the fact that
Registerfly.com has renewed many of these names, as you agent, and now you
have placed them in redemption, only adds to your problems. I may lose these
names, but Enom.com and Registerfly.com will extort no more money from me.
So I understand you position, your agent accepts the money, and you refuse
to deliver the service! And Enom.com see no problems in the conduct,
relationship, or liability, you will come to learn otherwise !

It is you choice, release the names or answer for these action in Federal
Court. In fact, the only actual issues, is will you face the liability for
refusing to release these name or not, Enom.com will be named in a
complaint. I can assure you that the damages, will be considerable. In this
county, issues of this nature result in huge jury awards. If you doubt my
resolve, you will have a rude awaking, as I have no hesitation as to filing
a complaint against all of these defendants.

You have my offer, take it or leave it...this meets my legal
requirements........now it is your choice. I am sure Enom.com received my
draft for damages that will constitute my complaint in Federal Court. I have
forwarded it to my Counsel, and this matter is proceeding. Just as you have
received the many certified letters, you will also receive a certified
letter which contains a complaint and summons. And then you can do as you
wish also. I will take a judgment and it will be enforced.

You have NO CONTROL over Registerfly.com, and that is your problem, not
mine, and you will have to answer for this. And there is no avoiding this. I
am again attaching the receipt for the renewal of three [3] of these name,
demonstrating that in the last week they were renewed at Registerfly.com.
Payment was tendered and accepted and you are on notice !

I knew that Enom.com lack the courage to follow through and place these name
in my account and bill me $160.00, per name! Do you hear that silence coming
from ICANN, Versign and Registerfly.com....that is DOOM....each knows that
Enom.com is set to take a major judgment.

I am ready to settle this matter today for $8,770,540 cash, as per my
demand.  I am sure ICANN and Versign, will file a cross claim against
Enom.com for their damages, as Enom.com has created this mess !

So, what is your answer!

Registry Operator Maximum Price Schedule

This schedule specifies the maximum price Registry Operator may charge for
Registry Services. In a manner consistent with Subsection 22(B) of the
Registry Agreement, Registry Operator may charge a lower-than-specified rate
for services, including not charging for a specified service. Except as set
forth herein or otherwise agreed, Registry Operator shall not be entitled to
charge for any Registry Service not specified in this Appendix G.

1. Maximum Initial Registration Fee for Registered Names

Registry Operator may charge a maximum of US $6.00 per year for registration
of each Registered Name (the "Initial Registration Fee") in the Registry
TLD.

2. Maximum Renewal Registration Fee for Registered Names

Registry Operator may charge a maximum of US $6.00 per year for renewal (or
extension) of registration of each Registered Name (the "Renewal Fee") in
the Registry TLD.

3. Fees for Transfers of Sponsorship of Domain-Name Registrations

Registrars may assume sponsorship of a Registered Name holder's existing
domain name registration from another registrar by following the policy set
forth in Exhibit B to Appendix F to the Registry Agreement.

For each transfer of the sponsorship of a domain-name registration under
Part A of Exhibit B, Registry Operator may charge the gaining registrar a
maximum fee equal to the renewal registration fee associated with a one-year
extension, as set forth in item 2 above. The losing registrar's registration
fees will not be refunded as a result of any such transfer.

    Transaction records from RegisterFly are between you and them. eNom
has no way to verify transactions that are not processed through our
credit card processing (RegisterFly uses their own processing). We did
not receive the renewal command and were not paid for the renewal of the
domains. We require a clear answer as to if you wish to redeem these
domain names or not. Please reply telling us yes, you would like to
redeem the domains at $160 per domain, or no, you would like them to be
deleted at the registry level.

     The domain names are only redeemable up to 72 days after the listed
expiration date (30 day eNom grace period + 42 day redemption grace
period). We are trying to work with you in accordance with eNom and
ICANN policy. All that we require is your cooperation. If you do wish to
redeem the domains, since you are a chargeback risk at this point we
will require that you either sign our credit card authorization form,
expressing your consent for the charge, or you may wire transfer the
funds. Let us know how you would like to proceed.

     RegisterFly is an eNom reseller partner, thus any domain names
registered through their interface are registered using eNom's registry
connection and reside in eNom's registry database. Both eNom and
RegisterFly are ICANN accredited domain name registrars, however,
RegisterFly uses eNom's backend to facilitate their registry connection.
As stated in a previous email, as far as the registry is concerned, the
domain names are registered with eNom (RegisterFly is the storefront and
eNom is the backend). Because of this we have the authority to allow you
to renew your domains directly through us if you are unable to
facilitate the renewal through RegisterFly.

     The domain names that you have listed are all currently listed in
the redemption grace period. What this means is that your registration
for the names expired and the domains were deleted from eNom's active
database. However, the names still reside with eNom at the registry
level, thus our ability to redeem the expired registrations. The fee for
redemption of an expired domain is $160, as noted in eNom's registration
agreement. If you are unwilling to pay the redemption fee the domain
names will not be renewed and will eventually be deleted. It seems that
you fail to grasp the concept that your registration of the domain names
expired, therefore they no longer belong to you.

I am in receipt of your email below and have read it and need
clarification on several issues.


1. Enom.com is willing to allow me to renew a number of domain names
that I registered at Registerfly.com, the fee for this renewal is
$160.00 (per domain). Registerfly.com is you agent / reseller.

2. The domain names at issues are names that Enom.com's agent / reseller
Registerfly.com refused to allow me to renew and Enom.com received
notice of Registerfly.com refusal to allow renewal.

3. Enom.com is a ICANN Accredited Registrar.

4. Registerfly.com is a ICANN Accredited Registrar.

If all of the above in not accurate, please let me know.

As such I am under a duty to limit my damages in any litigation that I
may file as to these names. I will open an account at Enom.com, and
provide such information to this account to Enom.com. Any charges above
$6.00, that Enom.com or any other entities assert for the
surrender/renew/transfer of my property, these domain names, will be
view as extortion, and paid under duress. Any such payment will only be
made by U.S MAIL after verification by mail of the assert demand, which
will be made by U.S. Mail. This will constitute Wire and Mail Fraud.

Surrendering, renewing and/or transferring of any such names will not
release Enom.com, Registerfly.com, Versign.com or ICANN from any
liability as to the conduct of these entities, including all action as
to these names and Enom.com offer and renewal / transferring /
surrendering of such domain names. I express reserve all rights to seek
such damages as any court may award for any claim that I may assert.
This surrendering / transfer / renewal of these domain names, is not a
settlement of any claims, release of claims or any release as to any
damages or claims that may or could be files. I express reserve the
right file any claims against Enom.com as to the demand for funds to
release, renew or transfer these domain names to any such account that I
may open and provide such information to Enom.com.

I will pay the maximum allowed under ICANN rules for a renewal, $6.00
(per domain), such offer does wave any claim. Any demand above $6.00
(per domain)will be view as extortion.

   With the exception of  'AtlantisInternetentertainment.com' and
'playerstreets.com', both of which have been transferred to Wild West
Domains, these names are all with eNom and currently listed in
"redemption" status. What this means is the expiration date on the
domains has lapsed and the domain records have been deleted from eNom's
active database. Domain names cannot be transferred while in redemption
status (no changes can be made at the registry level). In order to gain
control over the domains and transfer to another registrar you would
need to redeem the domains back into an "active" status.

   There is a $160 (per domain) redemption recovery fee in order to
reactivate the domain names. You can go to www.enom.com and open an
account (if you don't already have one) and we can bill you the
redemption fee and place the names into your eNom account. The other
alternative is that we can simply delete the domains at the registry
level, allowing you the opportunity to register the names as new
registrations with the registrar of your choice. The latter would be
much less costly, but you also run the risk of losing the domains to
others who may pick them up as the registry drops them. Please let us
know how you would like to proceed.

[2006-03-16]  I am enlcosing registerfly.com renew policy below, Does
registerfly.com have any lawful reason for refusing to allwo me to renew
these domain names?

RegisterFly.com allows a 30 day grace period after a name expires.
During this 30 day grace period you can renew your domain. After the 30
day grace period expires your domain will move to the redemption period
for 30 days prior to being dropped and made available again for
registration. Once the domain is placed in redemption you CANNOT renew
it via our interface.


[2006-03-19]  I would remiond you that Registerfly froze my account
duing this time period and refused to allow me to renew these names,
even with funds on depsot.

Does registerfly denie that registerfly.com refused to allow me to renew
these names?
