Please advise if there is an opportunity for the Policy Chair Candidates to 
meet with the Policy Councilors and the constituency representatives who are in 
attendance on Saturday. It makes sense to me that everyone from the 
constituencies would want to hear what the chair candidates have to say, so 
that they can provide guidance to their policy councilors who do the voting -- 
by that I mean, all constituencies.
I see from the Council minutes that there is an opportunity for the candidates 
to meet with the Council members. 
Can the council members of the BC advise the BC when this meeting is so that 
those of who are funding our travel to Seoul in time to attend Saturday's 
meetings can attend?

thanks, Zahid, for sharing this level of detail the BC members.
It is very important for the BC membership to be involved in giving guidance to 
its elected councilors or officers -- whichever the role, and when we omit that 
step, we shortchange the importance of the issues for both the membership,and 
for those who have the burden, and honor of representing the interests of the 
electorate. 
Thus, it is good that we have this level of detail before us, as BC members. 
First, since I know all three candidates for Policy Council Chair, and have 
some relevant experience in being a councilor, as well as working on task 
forces/now called working groups, I offer the following thoughts to my fellow 
BC'ers.
We are facing a new 'regime' of many changes, including new players in the non 
commercial users side of the house, and of course the other changes associated 
with having 'houses'. We are making major changes in the PDP process, in 
establishing working groups, and in realigning, ourselves, into a  more 
distributed structure of participation, representation,and decision making. We 
are also under criticism, in case any of our members are not aware of it, by 
the non commercial users, who have recruited hundreds of groups, and who are 
highly critical of the lack of membership and participation by a broader more 
distributed group of businesses.... This last item is a true vulnerability, and 
extends to the ISPs as well as our own business user community. In short, we 
have much work to do within the BC, as well as much at risk in the Policy 
Council, and much at issue in how we actually broaden and deepen business 
participation. 
I recommend that the BC elected councilors support Chuck Gomes. 
Let me explain why. Chuck has the broadest depth and expertise within the 
Policy process. He has demonstrated his even handness; ability to work in a 
productive and neutral fashion, and to respect the importance of inclusion in 
the processes.  This is a critical time when building processes, and 'testing 
them' and improving them really 'on the fly' will be the work of the next year 
or two for the GNSO Policy Council. 
I understand that there may be 'deals' that some are thinking are possible, 
where the vice chairs would balance any limitations of a chair. That isn't a 
good strategy.  The Chair needs to be capable, and experienced. 
As to whether it is a good idea for a BC councilor to take a Vice Chair role -- 
I  need to be convinced of that. 
There are only two BC councilors, and there is a LOT of work to be done, in 
representing the interests of the BC within the Policy Council. 
I can be convinced that Zahid would indeed be a great vice chair candidate, but 
I haven't seen the justification of this proposal for a BC councilor to be a 
vice chair... laid out for the BC. Again, I am open to supporting Zahid as a 
vice chair -- but I haven't seen the arguments and benefits and risks or the 
negatives aspects described for us, as the BC members, who need to provide 
input and guidance before any such negotiations take place. 
One thing that I think we need to be clear on and that is that the BC 
councilors need the support of the BC, before there is any outreach or 
discussion with others. So, we need to address this asap. 
I am sure that the elected councilors or past councilors would not be proposing 
or negotiating without having the needed discussions with the BC membership, so 
I welcome this opportunity to have this discussion.
I would actually propose that this kind of discussion deserves a conference 
call with the BC members -- not only an email discussion.  While time is 
limited, perhaps we could have an urgent call to discuss this. 
I can understand that some may think that the worse approach would be to have a 
registry chair, a vice chair from the contracted party house, and a vice chair 
from the non commercial users side -- it all depends, What is the role of the 
vice chairs? How do we replace the work of the elected councilor while they are 
devoting additional time to being a vice chair? There is a lot to discuss here. 
I would have preferred that we started earlier -- but at least, now we know 
that there is an urgency to address this.

Many thanks for the vote of confidence.  

 

I think the role of the Vice Chair is dependent on who ends up
being elected Chair of the GNSO.  If the Chair
has strong leadership skills, including being able to handle work load, draft
language and possibly mediate some, the Vice Chair role would not be as
burdensome.

 

In case the elected Chair avoids confrontation, cannot mediate
and will end up passing drafting language onto the Vice Chairs, the latter will
have to not only pick up the slack but will have to devote much time in
mediating and communicating (on lists and privately between the CSG and NCUC.

 

At present there are 3 candidates for Chair – have attached
emails in this regards from the Council list and also pasted a relevant one
below.  

 

In regards Vice Chair the NCUC and the soon CSG may have to come
up with a compromise on who they collectively will back as Vice Chair.

 

BC may wish to consider and provide ideas.

Part 2 _Each House determines a Candidate_

 

After council wide nominations are closed, each house
will be allowed to select one candidate for GNSO Council Chair from the pool of
nominees.

 

A candidate for GNSO Council Chair does not need to be a
member of the house selecting the candidate. Should the non
voting NCA be elected as chair he/she would be a non-voting chair.

 

Each house must announce their chosen candidate by 21
October 2009 at 23 UTC.

 

The two houses may, separately, select the same candidate
from the nominee pool if they so wish.

 

The candidates from each of the houses shall have the
opportunity of meeting with Council Members at the GNSO Working Group sessions
in Seoul on Saturday morning, 24 October 2009.

B. PROPOSED SCHEDULE FOR THE VOTING

 

For this election, the voting will take place at the

Avri Doria,
current GNSO Council chair, will serve as non-voting chair of the bicameral
Council meeting on 28 October until such time as a new chair is elected, at
which time the new chair will assume the chair responsibilities.

 

If an absentee ballot is required to complete the chair's
election, this will be a 24 hour ballot scheduled to end on 29 October. If no
chair has been elected by the end of the Annual meeting on 30 October, the
vice-chairs will assume the chair responsibilities as defined in the Bylaws and
a runoff will be scheduled as determined in the Council Procedures.

 

The winning candidate needs 60% of the votes of each
house.

 

The Council shall inform the Board and the Community
appropriately and post the election results on the GNSO website within 2
business days following the election.

 

In the event that the GNSO Council has not elected a GNSO
Council Chair by the end of the previous Chair's term, the Vice-Chairs will
serve as Interim GNSO Co-Chairs until a successful election can be held.

 

(Note: The Election of Vice chairs is house specific and

Thank you for this brief update. I think that the members of the BC really need
to be kept up to date on such topics. 



 





What are the duties of the Vice Chair, for instance, and how will
this new duty affect the representation of the BC? I am sure that we are all
interested in supporting a BC Vice Chair for the 'house', but am not at this
point clear on how that process works, and how the preferences and interests of
the members are taken into account.

The call for nominations has been updated for clarity, though no substantive 
changes have been made since yesterday.



The change involves clarifying that nominees must be members of the  council at 
the time the election is held and not necessarily at the time that the 
nominations are made.  This means that:


- a current council member who will not be in the new council is not eligible 
to run for chair


- an incoming council member who is not currently in the council is eligible to 
run for chair



Only current GNSO Council members are eligible to make nominations and second 
nominations.



Also clarified is the two part nature of the process.



The entire nomination process lasts 2 weeks. (7 to 21 October 2009)


- Week one is dedicated to council wide nominations


- Week two is dedicated to each House's section of their single candidate from 
the pool of nominees.

7.  The GNSO Council shall select the GNSO Chair for a term the GNSO


Council specifies, but not longer than one year.  Each House (as


described in Section 6 of this Article) shall select a Vice-Chair, who


will be a Vice-Chair of the whole of the GNSO Council, for a term the


GNSO Council specifies, but not longer than one year.  The procedures


for selecting the Chair and any other officers are contained in the


GNSO Operating Procedures.  In the event that the GNSO Council has not


elected a GNSO Chair by the end of the previous Chair's term, the Vice-


Chairs will serve as Interim GNSO Co-Chairs until a successful


election can be held.

2.2 Officer Elections: Chair and Vice-Chairs


The GNSO Council shall select the GNSO Chair and two Vice Chairs as follows:



a. The GNSO Chair shall be elected by a 60 percent vote of both houses.



b. Each house will be allowed one candidate for GNSO Council Chair. A candidate 
for GNSO Council Chair does not need to be a member of a house but must be a 
member of the GNSO Council. Should a Chair be elected outside the houses that 
Chair will be a non-voting Chair.


i. All ballots will include the "none of the above" option. In the


event that this option gets 60 percent of both houses, each house will


commence a new nomination period of not longer than 15 days. The


election will be rescheduled for no sooner than 30 days.



ii. In the case of a tie the election will be rescheduled no sooner


than 30 days. In the case of a second tie, each house will commence a


new nomination period of not longer than 15 days. The election will be


rescheduled for no sooner than 30 days.



iii. The leading candidate will be defined as the one with the highest


score. For each candidate, determine the percentage of vote received


in each house; add these percentages to determine the score; the


leader is the one with the higher score. (Maximum score equals 200.)



iv. In case neither candidate reaches the 60 percent of both houses


threshold, a second ballot will be held between the leader and "none


of the above."



v. If the single candidate does not reach the 60 percent of both


houses threshold, then each house will commence a new nomination


period of not longer than 15 days. The election will be rescheduled


for no sooner than 30 days.



c. Each house shall select a Vice Chair within their respective houses.



d. A Chair and Vice Chair may not be elected from the same Stakeholder Group.



e. The Chair or Vice Chair shall retain their votes in their respective houses.



f. In the event that the GNSO Council has not elected a GNSO Council Chair by 
the end of the previous Chair's term, the Vice-Chairs will serve as Interim 
GNSO Co-Chairs until a successful election can be held.


g. The Council shall inform the Board and the Community appropriately and post 
the election results on the GNSO website within 2 business days following the 
election.

A formal nomination period, for the election of GNSO Council chair for


the period 28 October 2009 until the end of the 2010 Annual meeting


is now open for two weeks from Wednesday, 7 October to Wednesday 21


October 2009, ending at 23:00 UTC.



The process of nominations for GNSO Council chair is divided into TWO parts:



Part 1: A council wide call for nominations  from 7 - 14 October



Part 2: A House specific process to determine the house candidate form the pool 
 of nominees 15 - 21 October





Part 1  _Council Wide Nominations for Council chair_



Wednesday 7 October 2009  to Wednesday 14 October 2009 at 23 UTC.



All nominations should be accepted and seconded within the period 7 - 14 
October 2009.



Only GNSO Council members are eligible to make nominations and second 
nominations.  Only GNSO Council members who will be in the newly seated council 
at the time of the election (28 October) may be nominated. 


  


Any council members who will be in that council may be nominated, even if they 
do not currently sit in the council and irrespective of House placement.


Nominations and seconds should be sent to:  gnso.secretariat [at] gnso.icann.org



Nominations and seconds will be acknowledged and posted to the Council list.



Nominees shall submit a candidacy statement in writing to the Council not later 
than 14 October 2009.
