Submission to ICANN regarding the request by the Czech Arbitration Court
for recognition as a provider of UDRP services.
This is posted on behalf of the European Communities Trade Mark
Association (ECTA) which is the principal pan-European body representing
the interests of those professionals who practice within the European
Union in the fields of trade marks and related IP. ECTA's Internet
Committee has considered the proposals submitted by the Czech
Arbitration Court as part of its request for recognition as a provider
of UDRP services. We believe that the Czech Arbitration Court will be a
good, efficient service provider. Introduction of their proposals could
benefit ICANN's UDRP service. However ECTA's Internet Committee as a
whole is not convinced it will be possible to introduce all of those
proposals within the present UDRP framework. Nonetheless, the request
for recognition by the Czech Arbitration Court should be favourably
considered by ICANN, and if, and to the extent that, certain proposals
are thought not to be in line with, or permitted by, the current UDRP
regulations those proposals should be made the subject of wider
consultation.
