Dear ICANN –
Regarding the proposed rules governing companies that provide WHOIS privacy
services (as set forth in the Privacy and Policy Services Accreditation Issues
Policy document):
I wonder if you have considered your liability in this issue? If a disgruntled
customer (or perhaps just someone who opposes the politics of a particular
site/business) were to be able to get the private information of the owner
because of you, and carry out an attack on that individual or their reputation,
could you not be held liable?
Even if you are somehow protected and immune to legal liability, I would humbly
submit that you are still morally liable.
I urge you to respect internet users' rights to privacy and due process.
- Everyone deserves the right to privacy.
- No one’s personal information should be revealed without a court order,
regardless of whether the request comes from a private individual or law
enforcement agency.
Private information should be kept private. Thank you for your time.
