ICANN should not regulate (require accreditation of) privacy and/or proxy
providers.
Privacy providers should not be required to provide any information to
anyone (including law enforcement) in the absence of an independent legal
obligation to do so (that is, when a valid court order has been issued).
Regardless of whether the domain is being used for commerce or not. If
privacy providers are to be accredited, then they should be required to
notify their customer when a request has been made by a law enforcement
agency (or anyone else) regarding that customer, except when it is illegal
to do so.
In other words, ICANN should not be an agent who, through its regulations,
causes privacy to be reduced.
