The current privacy-optional system is perfect and requires no change.
Law enforcement (or legal process servers) can contact registrars to umnask
privacy in matters involving breach of law. In the event of false whois
information, registrars can furnish registrant IP addresses, etc, however
the current proposal does nothing to eliminate that. It merely proposes
that anyone who registers a domain name elevates their personal and/or
professional life to public scrutiny by sole virtue of acquiring a domain
name? Anyone who can't recognize the enormous hazard in that isn't
intelligent enough to be entrusted to hold a job at ICANN. Astonished this
was even considered at all.
