eco Association of the German Internet Industry comment

This comment is respectfully submitted on behalf of eco Association of the 
German Internet Industry (www.eco.de), which represents more than 600 companies.

eco appreciates the fact that the new RAA shall be negotiated between the 
Registrars and ICANN. However, there are proposed changes to the RAA that 
affect the broader community and the multi-stakeholder approach as such. These 
are:

- The right to change the contract unilaterally by the ICANN Board of Directors 
with a two-thirds vote

It is for good reason that currently changes can only be made to the RAA 
without the Registrars approval by virtue of Consensus Policies. Such policies 
are based on a full community consultation within the framework of a PDP. This 
level of community consultation is undermined when changes can be made on the 
basis of Board decisions. 

- Data retention

eco supports the view taken by the Article 29 Data Protection Working Party in 
its letter to ICANN of Sept 26, 2012. In particular, data retention should not 
be introduced by means of contracts issued by a private corporation. Where 
Governments see the need for data retention, they should make laws requiring 
such measures.
