The following are my personal views.
The Board should not act on this proposal now. The by-laws provisions
that this proposal would amend will have to be completely rewritten over
the next few months to accommodate the restructuring of the GNSO
council. Since the Board has decided that the new Council will be
seated by the June 2009 ICANN meeting, this will necessarily require
that new by-laws be in place by that time. (Actually, they need to be
in place before any of the stakeholder groups chooses its GNSO council
representatives, and before the Nominating Committee acts to fill the
slots allotted to it.) If the drafters of the new by-laws believe that
term limits for elected councilors should be a feature of the
restructured Council, that provision should be proposed as part of the
overall by-laws amendment for restructuring. Since the current Article
X of the by-laws will become inoperative in a matter of months, the
bandwidth devoted to consideration of amending it now perfectly meets
the metaphorical definition of "rearranging the deck chairs on the
Titanic."
