David Roache-Turner (WIPO):consent to be not unreasonably witheld by
reference to certain objective criteria, and within a reasonable time period
David Roache-Turner (WIPO):...and certain not for licensing or other monetary
purposes indeed
Claudia MacMaster Tamarit (ISO):May I elaborate?
David Roache-Turner (WIPO):important to recall also the different category of
IGO protection under international law, as recalled also in the Beijing GAC
advice
David Roache-Turner (WIPO):we need to make the process as non-cumbersome,
simple and easy to use as possible, including to minimize burden on
organizations such as ISO and other potentially legitimate users
David Roache-Turner (WIPO):we may also need to explore possibilities for
certain open ended consents for certain organizations such as ISO, so they
don;t have to go through the process more than once for any legitimate
application or registration
Claudia MacMaster Tamarit (ISO):Right
Claudia MacMaster Tamarit (ISO):Agree with David.
Mary Wong:I'll need to confirm with NCUC & NCSG but I think that the 2 groups
will NOT support blocks or large-scale exceptions; more likely a TMCH mechanism
could find some support.
David Roache-Turner (WIPO):and we could define these on an objective basis to
maximize certainty and provide additional comfort, may also need to consider
standard form exemption forms (conceivably via a modified TMCH approach) so
registries could except a standard form consent for operational purposes
Claudia MacMaster Tamarit (ISO):Mary, we too would support the TMCH
mechanism. And would expect to find more support on this lower level
protection, for both IGOs and INGOs.
Claudia MacMaster Tamarit (ISO):We could also support your proposition Chuck.
David Roache-Turner (WIPO):I think TMCH is certainly an interesting idea
worth further exploration, but may require some modification for IGO use in
view of the particular status of the rights, for example on duration, cost and
some form of exemption process to address non-legitimate use (i.e. legitimate
registrations on certain criteria only would be allowed, but not any
registration by any third party including potentially cybersquatters)
Mary Wong:@David, that's true - but prob not an insurmountable problem.
Claudia MacMaster Tamarit (ISO):There may be something Mary.
David Roache-Turner (WIPO):Possibly not - but simplicty and timeliness are
also important I think, and wonder how realistic necessary adjustments to the
TMCH may be agreeable and implementable before new gTLDs would launch?
David Roache-Turner (WIPO):I think we also need to be careful not to equate
trademark rights with IGO rights to preclude certain uses in a trademark sense
of their acronyms under international law....
Mary Wong:@David, absolutely.
Claudia MacMaster Tamarit (ISO):There may well be acronyms of INGO, for which
they do not the same robust trademark protecion we have in ours. Highlights
the importance of working on criteria for INGOs.
