Dear fellow workgroup members:
I summarize the problem as I see it. While a registrant has the ultimate
authority regarding an inter-registrar transfer, the admin contact can
initiate and approve a transfer without a registrant's involvement. Most
registrars, maybe all, will notify the registrant that a transfer out has
been initiated and that the registrant can cancel it and that the transfer
will go through if the registrant does nothing. So, a registrant can return
from a one week vacation and find that the admin contact has transferred a
domain away without registrant approval. This can lead to a transfer
dispute.
PDP-B question 7 deals with how such a dispute should be handled. It may be
a good idea to review dispute procedures, but it would be far better to
require registrant approval before a transfer occurs and avoid most
disputes. IRTP rules require the gaining registrar to confirm the transfer
not the losing registrar. Back when the losing registrar was responsible for
confirming the transfer, there were many problems with transfers failing
because losing registrars simply would not confirm transfer requests. We
probably do want to go backwards and return that responsibility to the
losing registrar.
Solutions that I can see include:
. Making the registrant data part of the public whois, which has
noted security risks.
. Giving admin contact ultimate transfer authority, which has the
same security risks as above and may be outside the scope of our PDP.
. Establish some means for gaining registrar (with auth code) to
acquire registrant email address.
As I read the PDP, our workgroup should focus on providing a means for the
gaining registrar to contact the registrant. This is not the mandate of
group B. If we succeed, the following workgroup may still want to review
dispute procedures, but disputes should be significantly reduced.
