Restructure Drafting Team:
Staff wants to clarify its understanding regarding the Council seat issue in
the Bylaws. The original intent in the language was to MOVE seats
(unfilled) from Constituencies to Stakeholder Groups; therefore, the three
seats that were assigned to NCUC are (a) increased by 3 and (b) transferred in
whole to the NCSG. The NCUC, as a Constituency, does not keep any of the seats
previously assigned in the Bylaws. That was one of the provisions that the
Council, et al., wanted to ensure, that is, no Constituency is guaranteed a
Council seat which, Staff presumes, applies to existing Cs as well as new
applicants.
For transitioning purposes and to ensure continuity in the GNSO Council, Staff
had recommended that Councilors whose terms do not expire in 2009 (planned new
Council implementation) should be permitted to continue to 2010 and serve their
2nd year. For the NCUC, our records indicate that two Councilors would satisfy
that condition; thus, the NCSG would need to elect/appoint four new Councilors,
which could come from any of the Cs that the Board approves to be part of the
new NCSG (TBD).
