During discussions on the previous versions of the TC, one of the
points regularly raised was that this is outside of ICANN's core
mission and competence.
We have addressed this by making it clear that this is to be an
outsourced service and not operated by ICANN.
I suggest that we make this clear in the introduction to the TM.
Specifically, the sentence including "... the creation of a Trademark
Clearinghouse (TC) would be a beneficial implementation tool ..."
should be changed to "... the creation of a Trademark Clearinghouse
(TC), to be operated by an arms-length contractor, would be a
beneficial implementation tool ..."
Assuming my terminology is ok, this simply says up-front what we
later imply when we discuss the contracts between the TC Provider(s) and ICANN.
