I know him also and agree that Cédric Manara would be a good choice as an
academic.

        What does everyone think about Cedric Manara (www.cedricmanara.com
<http://www.cedricmanara.com/> )?  He's an Associate Professor of Law at EDHEC;
panelist to the Czech Arbitration Court (both for UDRP and ADR .eu Disputes),
the Kuala-Lumpur Regional Center for Arbitration, and an third-party Decider to
the Belgian Centre for Mediation and Arbitration; and is or has been expert to
intergovernmental, European or French institutions. I don't know him, but he
seems to have the academic and UDRP-related background we're looking for, and
he's not American.

Call

                Hi - that's a great question, Kristina. I don't think Eric
writes specifically about the UDRP; he is, however, very well-versed in the
Internet's technical jargon and cyberlaw generally, and has developed
considerable expertise in many aspects relating to online trademark problems
(e.g. keyword advertising, ACPA litigation).

                This is his webpage: http://www.ericgoldman.org/index.html and
here's a 2010 blog post he wrote about a US case that raised ACPA, wildcarding
and reverse domain name hijacking questions:
http://blog.ericgoldman.org/archives/2010/11/wildcarding_sub.htm (he blogs
about just about every online trademark case, it would appear!)

                I'd say he's a good resource for siting the UDRP within a US
trademark/legal context, and FWIW he's also a good speaker. I've no idea if
he'd be willing to do the webinar, so I'm not necessarily pushing for him over
others equally, or more, qualified for being more "UDRP-centric"!

                Cheers

Mary,

I'm not familiar with any of Eric Goldman's work on UDRP. (I am familiar with
his work on other issues). Can you send some links around to some
representative articles, etc.?

Thanks.

Another academic who is familiar with the UDRP is Eric Goldman (Santa Clara). I
know him quite well and can ask him informally if he'd be available and would
like to participate.

It's true that neither Michaels F nor G have done much recent academic work on
UDRP issues - Geist does track studies and updates though. I can also ask him
if folks would like, although maybe I won't if we agree on asking Konstantinos
and Eric.

Let me know,
Mary

Margie, et. al.,

In socializing the names of the people we talked about inviting to speak I have
come to think we should try to offer more breadth and less duplication of view.

In that vein, I would second Jeff Neuman's suggestion that Konstantinos
Komaitis be invited.

Further, I think Jonathan Cohen should be added, too, perhaps in place of
either Geist or Froomkin.

Cheers,

Berard

        Dear All,

        Here is a brief summary of the action items arising from today's call
related to the UDRP Webinar scheduled for May 10th:

        <!--[if !supportLists]-->·         <!--[endif]-->I will reach out the
UDRP providers to clarify my request for recommendations for speakers.
Specifically, the request was intended to identify individuals that
quantitatively had the most appearances before the provider in each of the
categories. This clarification seeks to use objective rather than subjective
metrics to identify speaks in each categories (panelists, respondents,
complainants, etc.).
        <!--[if !supportLists]-->·         <!--[endif]-->I will contact the
Registrar Stakeholder Group to identify up to 3 individuals from registrars
which implement the largest numbers of UDRP cases, from which one speaker would
be selected that could speak on behalf of the registrar stakeholder group on
issues that are of concern to the RrSG as a whole, and not reflective of only
the views of his/her registrar.
        <!--[if !supportLists]-->·         <!--[endif]-->With regard to
selection of the speaker from the academic perspective, the DT discussed
Mary's recommendations of Michael Froomkin (Miami) and Michael Geist
(Ottawa)-it was noted that these individuals may no longer be conducting
research/analysis on the UDRP and that their publications on the topic may be
dated. The DT is seeking to confirm this assumption and/or identify other
academics with recent work on the UDRP. [Mary- perhaps you can elaborate on
your understanding of their recent work?]
        <!--[if !supportLists]-->·         <!--[endif]-->Since several
providers were unable to provide recommendations by today's call due to the
Easter holidays, the DT deferred reviewing recommended speakers, and will
finalize the list on Friday's call. To date- the following names have been
received:
        Hong Kong Arbitration Centre suggests:
        <!--[if !supportLists]-->·         <!--[endif]-->UDRP panelists

                *       Mr. Christopher TO
                *       Mr. Anthony WU

        *       Attorneys

                * Ms. Gabriela Kennedy (Represents Complainants)

        * National Arbitration Forum (NAF) suggests:

        <!--[if !supportLists]-->o   <!--[endif]-->Panelists:
        <!--[if !supportLists]-->§  <!--[endif]-->Sally Able
        <!--[if !supportLists]-->§  <!--[endif]-->David Safran
        <!--[if !supportLists]-->o   <!--[endif]-->Complainants (outside
counsel)
        <!--[if !supportLists]-->§  <!--[endif]-->Paul Mc Grady
        <!--[if !supportLists]-->§  <!--[endif]-->Andy Coombs
        <!--[if !supportLists]-->§  <!--[endif]-->David Steele
        <!--[if !supportLists]-->o   <!--[endif]-->Complainants (inside counsel)
        <!--[if !supportLists]-->§  <!--[endif]-->Renee Reuter
        <!--[if !supportLists]-->o   <!--[endif]-->Respondents (outside counsel)
        <!--[if !supportLists]-->§  <!--[endif]-->John Berryhill

        <!--[if !supportLists]-->·         <!--[endif]-->The DT is considering
including a representative from ICANN Compliance (Khalil Rasheed) to
participate in the Webinar, to briefly share its experience of issues that
arise with regard to implementation of the UDRP.

        The next call is this Friday Apr 29 at 1500 UTC due to the need to send
out invitations to speakers this week.

        Best regards,

        Margie
