I just finished listening to a 45-minute presentation
entitled:  "WHOIS Data Restrictions:  The ICANN Policy
Initiatives to Limit Access" (speakers were Steve
Metalitz, J.Scott Evans and Margie Milam) that was
followed by a Q&A session in which the question was
posed:  "Will there be a back door available to us?"  

Anytime that a new regime is presented, invariably
there will be those that will seek to circumvent the
established process.  We will be needing a sanctions
program to protect the integrity of the data provided
to registrars with appropriate penalties (such as, for
example, immediate loss of accreditation) that may be
levied on registrars for willful release of data that
should have remained confidential...  

Note:  this would fit into our obligation to discuiss
"what happens if the responsibilities are not
fulfilled?"
