Who regulates OPOC behaviour? E.g., OPOCs that repeatedly do not respond
to requests or are proven to be of bad intent?
 
Section 5
388. Under Dutch civil law a natural person is also a one person
company, as are several forms of partnerships. This is not reflected in
the proposal. I'm unfamiliar with the situation on this topic in other
countries. The distinction between legal and private as such is a
sensible one, so agreed.
 
401. Agreed, if an LEA can have access to data of a private registrant
as discussed in section 6 and it is possible to challenge a registration
and have it changed or closed after complaints are made.
 
Section 6
 
436. In the EU several LEA's enforcing spam (combined with fraud) and
malware work under administrative law. So it is suggested to add
administrative harm.
 
454. Is this meant to keep out old fashioned spam? It should say where
law is infringed, whether penal, civil or administrative.The examples
given all look at the content of the message. OPTA would not want the
messenger excluded, nor botnet herders, nor domain name herders, etc.
 
458. What is "timely"? OPTA would like to have a definition of timely,
before we can agree. When working on an investigation OPTA, as LEA,
favours this to read: "direct".
 
466. OPTA does not favour any restrictions in numbers of access. We may
have to research dozens or maybe thousands of domain names in one case.
OPTA must be able to do this "timely".
 
468. Carole Bird (RCMP) has already explained why external record
keeping is not favoured by LEAs.
 
This afternoon/ will be my last session on the working group because of
holidays. Thank you all for understanding the position of a LEA like
OPTA. I express the hope that a document will follow from our work that
reflects all concerns and achieves a result that is workable for all
concerned.
