I noticed just a couple changes that might be productive:

 

2.2, lines 153-154: Perhaps change to "It is not intended that the
implementation of this need create any particular legal relationship
that may exist in national law, other than an enforceable contract."
Why? I think you mean that this isn't meant to imply that any specific
relationship (such as agency, agent for service of process, etc.) is
necessary. But, alternatively, it could be construed as saying that the
OPoC's obligations need not be enforceable by the registrant. While
we've focused on the OPoC's responsibilities being enforceable in a
broader sense (hence, consent, per 2.4), I think it that the
responsibilities should also be enforceable to the registrant, for her
protection, in case the OPoC turns into RegisterFly, so to speak.

 

2.3, 2.4, lines 182, 217. Delete "anyway." To be clear, I don't have a
problem with including the comment, I'm just saying that "anyway" seems
superfluous and to confuse whatever point is being made here.

 

I intend to make a record of my positions on the various portions of the
report (and thank Avri for the helpful table format she supplied), but
I'm not sure that need be done before the deadline set below. It seems
to me Phillip has for the most part accurately described the levels of
support/agreement/etc. (even though, to be clear, that's not to say I
"agree" with--or in Avri's lexicon, "support"--the sections marked as
"agreed," or the totality of the OPoC proposal as envisioned by the
report).

Please find attached the outcomes report version 1.6.

 

This I hope captures the last two weeks of discussion on list and on our
two calls.

Changes compared to v1.5 are:

- new and clarified text;

- revised levels of support;

- revised section 7 (with text transferred from section 2);

- new section 8 (further studies).

(I considered issuing a red-line tracked version but there have been too
many changes to make this a useful tool.)

 

I would like to call a halt to changes of substance on the issues: these
we have well covered.

I would like to invite any comments where you feel any opinion on the
substance is NOT yet recorded.

Please do NOT repeat earlier opinion: that will just make life more
challenging to weed out duplication.

Please do WITHDRAW earlier statements of disagreement if you now believe
the revised text is something that you can support.

 

Comments are open for one week until mid-day Thursday 9 August.

 

After that we will issue version 1.7 which will factor in any changes
(as above) along with factual and contextual additions from ICANN staff.

 

I will advise later how long version 1.7 will be up for comment before
completion of the group's work.
