I've had the attached paper prepared to support the Committee's further consideration and discussion of mechanisms that could be used in resolving controversies/disputes relating to a new TLD application. The paper, which was prepared by a consultant, Miriam Sapiro, provides more information on a range of options, from using mediation to help parties contending for the same string resolve that issue, to using a panel of inquiry or a form of arbitration to resolve disputes about controversial strings (along the lines of the UDRP). As noted in the paper, there are various institutions that provide these types of services, ranging from commercial providers to international organizations. The paper is intended to simply give you a broad sense of what is available and to help advance your thinking in this area. It is not intended to suggest answers or recommend providers. Further work can be undertaken once the GNSO has had an opportunity to discuss the options and issues outlined above.
