Colleagues
I thought it would be helpful to give you an update on yesterday's
small group meetings on Recommendations 6 & 20.
It seems that the group has reached agreement on Recommendation 6.
The examples set out in the second paragraph are intended to be
illustrative and may be used by the implementation team to provide
guidance to applicants and instructions to evaluators so that, in the
event of an objection, any independent panel would have a series of
tests against which to analyse an objection.
"Recommendation 6:
Strings must not be contrary to generally accepted and
internationally recognized principles of law.
Examples of such principles of law include, but are not limited to,
the Universal Declaration of Human Rights, the Paris Convention on
the Protection of Industrial Property, the Agreement on Trade-Related
Aspects of Intellectual Property Rights (TRIPS), the Berne Convention
on the Protection of Literary and Artistic Works, the International
Convenant on Civil and Political Rights (ICCPR), the Convention on
the Elimination of all forms of Discrimination Against Women (CEDAW)
and the International Convention on the Elimination of All Forms of
Racial Discrimination."
With respect to Recommendation 20, the following text has been sent
to the small group as a result of detailed discussions on the call
yesterday afternoon. We are waiting for further clarification, if
any, from the NCUC. We would expect that this text would be
finalised shortly.
"Recommendation 20
An application that is targeted to a specific community may be
rejected if it is determined that there is substantial opposition to
it from significant
established institutions within the targeted community."
There have been a number of helpful suggestions about definitions for
"substantial", "significant" and "established" which will be picked
up by the Implementation Team in developing the methods by which this
recommendation would be used in the application evaluation and
objection processes.
At the next Committee call on Friday 12 July, a member of the
Recommendation 6 group will give an update to the Committee and Chuck
Gomes will provide the update from the Recommendation 20 group.
