MarkMonitor's Specific Comments to Module 4
MarkMonitor is pleased to submit the following additional comments regarding the Guidebook: MODULE 4: Efficient Mechanism for Contention Resolution: Section 4.3- Auctions should not be adopted as a mechanism for string contention resolution if there has been an objection filed by a rights holder. This might occur if ICANN decides not to adopt the findings of the DRSP, and the rights holder has submitted an application for the string. To do so would enable ICANN to benefit from potentially infringing TLD applicants. Contract Execution: Section 4.4- If an Applicant is in good faith negotiations with ICANN on the Registry Agreement, ICANN should not have the right to assign the contract to the runner-up applicant if the contract has not been signed within 90 days.
