MarkMonitor is pleased to submit the following additional comments
regarding the Guidebook.
Registry Compliance: Sections 4.2
and 4.3- Similar to the concerns raised under the ICANN Registrar
Accreditation Agreements, ICANN should include graduated
sanctions/enforcement tools to be used against registries that may not
comply with ICANN requirements. This would be particularly useful if a
new TLD deviated from its stated purposes and failed to comply with its
acceptable use policies.
Rights Protection Mechanism: Other rights
protection mechanisms should be encouraged in addition to the UDRP.
While the UDRP should continue to play an important role for brand
holders seeking the remedy of transfer or deletion of a domain name,
other rights protection mechanisms could be adopted to supplement these
rights. Please refer to MarkMonitor's separately filed endorsed comments
for details on the types of RPMs that would be beneficial to brand
holders.
