It is ridiculous and wrong for ICANN to attempt regulation of public morality or public
"good" on the internet. How do you apply ANY reasonable standard in a world
of highly divergent cultures and morals? It is IMPOSSIBLE. Your application of trademark
law would illegally apply it in ways previously unheard of, and beyond any international
teaty or law.
How ICANN will adjudicate disputes is both unobjective and opaque. ICANN is not, and can
really never be, properly set up to make thee determinations. There is no legal
jurisdiction and no political accountability. Furthermore is gives a distinct and perhaps
insurmountable advantage to well-funded entities, turning intellectual property rights
and trademark law on it's head in favor of "who has the most resources to
litigate".
All NON-TECHNICAL and NON-OPERATIONAL criteria must be removed from ICANN
policy. This is the ONLY way to ensure free expression, non-discrimination, and
innovation. Do not become another roadblock to progress.
