Private Media Group

Founded in 1965, NASDAQ listed Private Media Group (PRVT) is a
brand-driven world leader in adult entertainment and Globally
Distributes ITS That premium quality and content of select third party
Including Platforms multiple studios via internet, mobile, broadcast,
DVD and magazines. Private Media Group owns the worldwide rights to ITS
Extensive and Growing library of high-quality content, And Also licenses
STI Private and "Silver Girls" trademarks Internationally for a Variety
of exclusive consumer products. Private's 2009 acquisitions of world
leaders in video on demand, Gamelink and Sureflix LLC, and the ecommerce
technology firm, Eline LLC, Established as the world's Private Leading
adult content and distribution company in the digital media sector. Ilan
Bunimovitz, CEO of Private Media Group, states ''One of the
requirements for a sponsored top level domain is "broad-based support
from the sponsorship community." The minority opinion of the Internal
Review Panel states that ICM "never satisfied the sponsorship
requirements and criteria for a sponsored TLD." That opinion is
correct; ICM did not satisfy the sponsorship requirements because it
does not have support from the adult entertainment industry.
Furthermore we were never contacted nor consulted in the first place!

ICM claims that those who pre-registered .XXX domains with ICM meant to
simultaneously register their actual support for the TLD. ICM's
registration process mandates signing onto a statement that states,
"Support XXX-wish to register" (http://www.icmregistry.com/join.html
<http://www.icmregistry.com/join.html> ) no option is given for
defensive registrants who oppose .XXX. Most registrations that ICM has
from the adult industry are from people and companies who have
defensively registered their domain name in an attempt to protect their
brand and traffic.

ICM's proposed regulatory board, the International Foundation for Online
Responsibility (IFFOR) has no business regulating and setting standards
for an industry it in which it is not a part. The potential for
censorship and unwarranted regulations is great and a real threat to the
adult entertainment industry. ICANN is not in the business of
regulating industries and would be ill-advised to start now-especially
in this case where those regulations could easily stifle the
free-flowing exchange of expression.

We have reviewed the March 26, 2010 process options for further
consideration of the ICM application for the .XXX sTLD submitted by
ICANN CEO Rod Beckstrom and General Counsel John Jeffrey. We support
option #3 denying ICM's application for a .XXX sTLD''.
