We are adamantly opposed to the untested URS system being imposed on .net
domains. URS is clearly a scheme being promoted by overreaching trademark
interested in and effort to stack the deck against domain owners in their
attempts to lay claim to domains they are not entitled to. We already see
such attempts made against owners of even the most generic domains over and
over in what amounts to little more than attempts at reverse hijacking. The
existing UDRP system, while not perfect, is clearly more fair than URS in
that it at least gives both sides a fighting chance. Imposition of the URS
would simply be yet another instance of ICANN turning the keys to the store
over to a single favored party at the expense of all domain registrants.

 

In our opinion it would be outrageous for ICANN to even consider imposing
new gTLD "rights protections" on existing gTLDs without careful study of how
they do or do not work with the new gTLDs.  It is certainly unfair to impose
URS on .NET registrants. Individuals who want to acquire future new gTLD
domains would be notified in advance that they will be subject to URS.
However, .NET domains have already been acquired with the understanding that
registration and use would only be subject to possible UDRP review. Changing
the rules after the fact would be an un-American outrage and one we would
urge ICANN not to countenance.
