As important as it is to protect the interests of trademark holders from
those who would engage in trademark infringement, it is also very important
to protect the interests of registrants who engage in the lawful use of
their registered domains. The proposed Uniform Rapid Suspension system (URS)
fails to sufficiently account for such lawful uses, making it far too easy
for trademark holders to deprive legitimate registrants of the right to use
their registered domains in a manner consistent with trademark law. The URS
system lends itself to abuse by trademark holders against other registrants,
including against those registrants who hold legitimate trademarks in
different markets than those of the allegedly infringed mark (the
nissan.comdomain being the perfect example of this).
The current UDRP process is an effective means of protecting trademarks
against abuse and should not be replaced with a system that facilitates
abuse in failing to provide sufficient protections for registrants engaging
in the lawful use of registered domains that happen to coincide with or are
otherwise similar to a registered trademark.
