Registrars should be forbidden from keeping the expired domain names
from their customers if the customers do not renew.
They should be auctioned but the registrar should not be permitted to
keep any domains themselves in "house portfolios". Additionally,they
should be required to auction the names, and not allow them to be
given exclusively to an individual or group of 3rd party entities.
This prevents them from opening up holding companies to bypass any
warehousing restrictions.
I also believe the current registry registrar agreement requires
registrars to release expired domain names, however, this is not being
enforced by ICANN or the registry.
