I am an intellectual property lawyer. I recently became aware of the
motions pending before GSNO. The WHO-IS data bases are critical tools
that intellectual property lawyers use to both protect our clients'
rights and to acquire new rights.
The most pertinent and critical use of the WHO-IS data bases is to
provide our clients the ability to monitor their trademarks and stop
infringement on the Internet. Because the information is readily
available, our clients' can contact infringers and try to resolve
matters amicably before resorting to UDRP proceedings. In instances
where registrants have used privacy shields, it becomes impossible to
contact the registrants and forces trademark owners to pursue either
UDRP proceedings or anitcybersquatting actions.
In addition to the contact information, the WHO-IS data bases provide
information about the date of registration of the domain names. This
information is useful in analyzing rights and insuring that the
trademark owner's rights precede the domain name registrants.
For these reasons, I urge you to adopt Motion 2 and reject Motions 1
and 3.
