Dear Sirs,
I refer to your previous email dated October 24, 2007 regarding the
Whois System issue.
I fully agree with the suggestion by the INTA's Internet Committee. It
is essential to have a comprehensive overview of the situation before
choosing a final solution. Therefore I support the motion No. 2
I would like to point out that it is essential that whois information
remain public and accessible. Whois databases help right owners to
identify Content and Host providers of websites. It is an effective and
efficient way to contact infringing websites and their owners.
In addition to that, ICANN must find a way to improve the level of the
accuracy of the details registered in the Whois databases by increasing
their pressure on the registrars.
When you are fighting against infringing websites and especially
websites selling fake products or counterfeited products whois recorded
details are almost always false. In such cases and when the
infringements are clearly identified it would be necessary to find a way
to suspend immediately these infringing websites. Even when reporting
through the Whois Data Problem Report System inaccurate details related
to the Content provider or Host provider the problem remains still the
same and no one takes any action against the infringers. This point must
be secured! And whois databases must be accurate!
Best regards,
Kristian Olenik
