In fact no, not all generic names have been trademarked. Just because a few surprises
have been trademarked (info, shop, shopping) does not mean all have. I don't see
trademarks for creditcards or domains and I'm sure there are many more. The point
is while i agree with you about the absurdity of generic tms, many people find
this a debatable area. There can be no debate however with the fraud we've seen with
the fake tm apps in the afilias sunrise and in my opinion, we must not cloud the
issues. They must eliminate this fraud first then correct this process that allowed
this happened. What you are saying is important and relevant I just think we
are not even there yet. I think you are just providing weasel room for people
to avoid the fraud and make it is a discusion about generic tms.
