In this forum, some of our well-meaning friends have expressed the view which runs
something like this " well, it is true that sunrise period has been a fiasco but,
there is little that Afilias can do at this point of time because if they make changes
in the policy they will be slammed with number of court cases". Not true.
There is no legal impediments to effecting any changes in "Afilias Sunrise Registration
Challenge Policy .info Clause 7 of said policy is reproduced below:

7. Policy Modifications.
Afilias reserves the right
to modify this Policy at any time with the permission of ICANN. We will post
the revised Policy at htt://www.afilias.info at least fifteen (15) days before it
becomes effective. Unless this Policy has already been invoked by the submission
of a challenge to the Center, in which event the version of the Policy in effect
at the time it was invoked will apply to you until the dispute is over, all such
changes will be binding upon you with respect to any Domain Name registration dispute,
whether the dispute arose before, on or after the effective date of the change.
In the event that you object to a change in this Policy, your sole remedy is to cancel
your Domain Name registration with us, provided that you will not be entitled to
a refund of any fees you paid to us. The revised Policy will apply to you until
you cancel your Domain Name registration.Unquote
Afilias+ICANN do you see, only
one holding you back to do the right thing is YOU? THINK! you have nothing
to loose and every thing to gain. ICANN, you can salvage your reputation, at-least
partially, that you don't listen!
Afilias, least you can do by tomorrow is to announce
postponement of the challenge round for a couple of weeks. Ofcourse, after
getting permission from ICANN. That shouldn't take long. This will be
well within 15 days notice period that you are required to give to effect any modification
in the Policy and at the same time it will give you valuable time to think things
over and make changes, if necessary.
