This proposal makes sense. It carefully balances the rights of TM holders and domain name registrants under the circumstances. I would make two minor changes. First the land rush winner should be required to submit his challenge within the 120 day period, with the challenge heard immediatly after the 120 day period is over, after all TM challengs are heard but before any registry challenges. Secondly the fee should be the same as that charged to a TM challenger.
