No lawyer will take the case. All that can be claimed for are the pre-registration fees spent on names that are fraudulently taken (and even these will be released when successfully challenged by Afilias). If you were to win, which I really doubt, your award wouldn't even be enough to pay one lawyer from the third world. Afilias has fixed the problem. End of story.
