left for the remaining trademark holders to protect their marks."
Perhaps LaPlante
wants them to protect their trademark from all the other trademarks with the same
mark.
Think about it - when Afilias get another TLD registry, for example .suckers,
trademarks can protect their mark in that also.
Ask them to deny; many THOUSAND
new open TLDs will not sort out any of the problems - even if every one had a 'Sunrise
Period'.
For example - thousands of trademarks using word 'Apple' have no guarantee
of being able to use name.
Apple computers will still make claim to every Apple.[anything]
- even though they share word with 727 others in the USA (plus all those in 200+
countries).
It will not solve the problems of 'consumer confusion', 'trademark
conflict' or stop anybody 'passing off'.
A domain is not a trademark - if word
is shared with others it cannot be - it has to be unique or causes 'consumer confusion'
or 'trademark conflict'.
A domain is just a word or words from our language.
Words
that are used by everyone, for whatever reason we choose.
The rich lawyers bully
people, to steal these words from them.
Words cannot be controlled by big business,
corporations and Government - yet , as all words are trademarked, they abridge peoples
use of whole vocabulary.
The authorities are expert at spin, lies and propaganda.
