GaryWhichever route is taken (and thats up to Afilias in the end!) I think one
principle is over-riding:
The main group of people who have suffered a major injustice
(and de facto fraud) are the Landrush pre-registrants.
I think as a matter of justice,
it is important that the final resolution protects the 95% who have lost out and
been defrauded EVEN IF there is a 5% group who face difficulties applying in the
last days.
Put another way, I don't think that measures to protect 5% should be
introduced, if the result is to disenfranchise the 95%.
I think it is pretty clear
that the bulk of Landrush applicants have applied already, and indeed, anyone applying
for Landrush now would have to need their heads examining!
Therefore, if as many
safeguards as possible can be put in place, and with simplicity, then I still favour
the Domebase proposal:
ALL names to be available at Landrush.
If randomised
winner gets a name already Trademarked, then that name is reserved for the winner
if a successful challenge ensues.
It is simplicity and it is just.
