While I'm certainly no fan of ICANN as presently constituted, I fail to see where Iperdome has any legal claim for reparations.  ICANN, whether it's democratic or not in its structure, has no legal or moral obligation to grant any company's request for a TLD of its own.  That they chose not to accept Iperdome's application for .per, and instead accepted a different company's .name domain, doesn't seem to be a legal tort against Iperdome, unless they're claiming they have some sort of natural inalienable right to be added to the root zone themselves.
