I have asked several registrars for refunds for landrush registrations that were obviously fraudulently registered during sunrise.  You can see from the responses below that some registrars are using the possibility of a future landrush as an excuse for not refunding pre-registrations.   I have seen no evidence that Afilias is leaning toward a future landrush, and the letter today from Connelly seems to support this.

From TotalRegistrations: “…it is possible that if the domains that you have pre-registered have in fact been registered by someone with an invalid trademark that they will be re-released and your pre-registration submissions will be considered.”

From IDR - Internet Domains Registry: “…It is our understanding that a “mini land-rush” may be scheduled for these domains at a later time, at the moment we have no official information from Afilias, we will advise you as soon as we have more information.”
