||Afilias had "right to refuse or cancel any Sunrise Registration at any time"
Based on the following sections from Afilias Registry-Registrar
Agreement, Afilias clearly had/has the ability to cancel any Sunrise Registration
at any time and/or to ask the registrant for more information. In fact,
names in violation of the Sunrise eligibility criteria (e.g. complete omission of
trademark information) are specifically mentioned as a reason for cancellation.
Exhibit E, I:
Registry Operator may transfer
or cancel any Registered Name (i) for violations of this Agreement and its Exhibits
or (ii) to correct mistakes made by Registry Operator or any Registrar in connection
with a domain name registration
Exhibit E, V.3:
During this Sunrise Period, owners of any current (non-expired) trademark registration
having national effect (including, for example, European Community Trademarks (CTMs)
but excluding United States state registrations) that issued prior to October 2,
2000 will be eligible to register a domain name that is identical to the textual
or word elements of such trademark or service mark.
Registry Operator reserves
the right to refuse or cancel any Sunrise Registration at any time and to request
additional information relating to a Sunrise Registration from the registrant
