You will lose. You can't base a case on emotion. Calling someone a bozo might be
cute in a general forum, but it carries nothing in a court or in a pattern of logic.
Emotional anger may act as the engine behind getting a case together
but in the end, you have to make sense. Every single prereg agreement at the registrar
made you agree that the names may never be made available for any reason. Couple
that with the fact that Afilias has said it will go after the fraudsters in December
and with the fact that Afilias does not have to delete fraudulently registered names
no matter how much you want to believe they do equals you with a very weak case.
In fact, they are going to delete the bogus registrations. Just not till December.
Preregistration was a risk we all took. I agree with everyone here that the sunrise
was an abomination and that Afilias created this with their absurd sunrise policies
but I believe people should focus more on provable fraud especially with individual
registrars. This angle might prove more fruitful. But good luck all the same.
