I spoke with lars directly from sp and he acted like he did not know. He thought that all you would need is a live website to prove no bad faith and not an actual tm to survive a challenge. When I showed this wasnt true, he adjusted his next email.  I don't believe him. I think he was just milking it all the way down the line.
