I don't know about the challenger you mention, but there are in fact dozens of owners of registered "XXX" trademarks listed in the official U.S. trademark registry, http://www.uspto.gov, including the famous Mexican Tres Equis beer which would get xxx.biz if it was awarded on merit.  There are lots of "XXX" trademarks registered in other countries too - see for instance the Japanese trademarj registry at http://www.jpo.go.jp - Peter Maggs
