Because I am so against further bullying tactics to retrieve geo names from people
who have an equal right to them, if telling the Hawaiian authorities about Leopold
may make this more likely to become a reality, then I think it too much of a sacrifice. But
although arguably TM holders should have no more right to a domain than anyone else,
wipo has changed all that and there is little that can be done about that in the
short term. Therefore perhaps Hawaii TM holders should be informed about this theft.
Leopold would become a victim of the bullshit culture she writhes in. The global
legal implications of a TM holder taking the name would be far less that if a local
authority did since it's already the norm with wipo, so I don't think it would increase
the risk to the internet community (when you consider that it's a bogus sunrise and
not a generic owned legitimately). And as you say, if a TM holder did challenge
her for it, ICANN may confiscate it off them later anyway.
