Subject: A case study in both Cybersquatting and Sunrise Cheating

A Canadian pseudo company (Mustard Seed) that has registered an excellent selection of names during the info Landrush, is playing in a shaded area of the Sunrise rules.

They have a TM application in Canada for the name "POCKETPC.CA", which hasn't been granted as a Trademark yet. This didn't stop them from claiming the name pocketpc.info..

They have an index site at pocketPC.info, and aside from the fact that they did not own a valid trademark at the time, it is quite interesting to try and understand the logic of trying to sneak one by "Microsoft"..

I know there are a few people on this forum who would love nothing more than to stick one to the big bad corporate-foes but I also think that there is a great deal to be said about common sense and fair business practices.

It seems to me that Mustard-Seed is a company that likes to tread on the boundaries of the rules, would be very interesting to see how many times they will be named in WIPO/UDRP and or other disputes.
