Opinion: It might be legally impossible for a registrar to vest an entity with ownership of a sunrise domain registration where the entity indicates they do not meet the trademark requirement(s). It might be legally impossible for a registry to accept and/process a sunrise registration application for an entity where the entity indicates they do not meet the trademark requirement(s). It might be that a valid sunrise registration contract can not exist since the entity indicating they do not meet the trademark requirement(s) is not eligible to hold a sunrise domain registration.
