IANAL but am sure any will tell you; that a business has to take precautions to make sure customers are not defrauded. In this case I do not believe there is any doubt - they KNEW about the FLAWS in the system that allowed customers to lose money. I would call that FRAUD - wouldn't you? Would any lawyer like to contradict that?
