Eastman Kodak Company submits the following comments
on ICANN's proposal to add new top-level domain names.While there may be good
reason to add a limited number of top-level domain names, particularly ones that
are geared to a specific field of interest, Kodak suggests taking the "go slow" approach
and that only a very limited number of top-level domain names be added at this time.
It is Kodak's view that adding top-level domains will increase the opportunity and
likelihood of cybersquatting and other infringements and misuses of Kodak's valuable
trademarks.
With the .com top-level domain alone, Kodak has encountered literally
hundreds of registrations that include KODAK, or other trademarks owned by Eastman
Kodak Company. Kodak has serious concerns that this activity could be drastically
multiplied by the addition of top-level domain names.
As for the UDRP, it should
be applicable to all newly-adopted top-level domains. This procedure would
give trademark owners a vehicle to take action against bad-faith registrations for
any newly-adopted top-level domains, as it does today with the .com and .net top-level
domains.
