Administrator versus dmain owner

Current Procedure:
1. Client contacts Hosting company to set up account.
2. Client submits available domain name for Hosting company to register.
3. Hosting company asks Registering company to register domain name.
4. Registering company registers domain name, ceding ownership to client but
administrative control to Hosting company.
5. Hosting company eventually closes and goes out of business, and refuses
to answer email.
6. Registering company refuses to transfer domain at request of domain owner
without ADMINISTRATIVE approval of Hosting company,  which is incommunicado,
citing ICANN rules.
7. Despite directions by Hosting company to "Contact them ´{Registering
company} to release domain name to you directly", Registering company
steadfastly refuses to do so.
8. Client is unable to transfer domain, despite being the owner of the
domain.
