Tlhis is the type of practice that should be "handled" by ICANN via 
contract with the registries.  The registry should have the obligation to
correct the wrong at registry level.  It is a simple matter with a thick
registry, but not a thin model.  However, the registry (Verisign) in this
case could still ensure it is done if it chose, by effecting the transfer
and having the gaining registrar make the correction.  All the registrant
should have to do is prove he registered the domain and also that he
attempted to make changes/transfer prior to its expiry.  Logs of phone
calls and retained emails are probably proof, but there should also be
snail mail with proof it was sent.

This type of practice has been brought to light several times.  It is
abhorrant.
